Fundamentals of Industrial and Business Law

Introduction into the theory of law, principles of normative regulation, the role and position of law, basic terminology and categories, private and public law, history of law, fundamentals of the law system of the CR, brief development of constitutional and civic law from 1918 till today, fundamentals of valid business law of the CR etc.

Learning outcomes of the course unit

Capability of a logical thinking, deduction and one's own judgment. The students will acquire basic information on the law and its place in the cultural extension of the society life, on topical problems of a legislation practice and on a legal regulation in force, in particular in the field of civil and trade law as well as on the sector of intellectual property laws.

Prerequisites

Knowledge at the level of a secondary school graduate, current information on the bases of the political system of the Czech Republic, general knowledge.

Teaching methods depend on the type of course unit as specified in the article 7 of BUT Rules for Studies and Examinations.

Assesment methods and criteria linked to learning outcomes

By means of a classified credit granted at the end of the relevant term.
Presuppositions of a credit granting: Successful result in the final test in writing

Principles of a normative regulation
Role and position of the law
Basic legal terms and categories
Private law and public law
Historical development of the private law from the Primeval Times up to the present (in brief)
Bases of the legal system of the Czech Republic
Position of the trade law in the domestic legal system
Sources of the Czech trade law
Basic principles of the legal regulation in effect in the field of trade law
Legal entities of the trade law
Trading companies and cooperatives (basic classification)
Term and basic principles of the competition law
Contractual law; commercial obligations
The most important types of contracts in accordance with the legal regulation in force (Purchase Contract, Performance Contract)
Structure of the intellectual property laws
Chosen sorts of the intellectual property laws
(bases of the industrial law, legal regulation in force in the field of the patent law,
copyright in the light of the legal regulation in effect).

Aims

Subject objectives: the subject is focused on strengthening and extending the elementary legal consciousness of the students and on helping them orientate in the law order of the Czech Republic in force, in particular in the field of private law.

Specification of controlled education, way of implementation and compensation for absences

The participation in the lecture-courses is not compulsory. For the students of a combined study form consultations are available. Each of students has to take part in consultation weekly and problems of subject are solved.
