Příspěvek se zabývá řešením otázky spojené s oceněním stavby, která je v „havarijním“ stavu způsobeném absencí základní údržby stavby v konkrétním příkladě a to s vazbou na postupy podle zákona č. 183/2006 Sb., o územním plánování a stavebním řádu (stavební zákon) a vlivy majetkoprávních událostí při řešení nápravy stavu stavby. Poukázáno je zejména na problémy: - možností úřadu věcné a místní příslušnosti na zjednání závadného stavu stavby podle stavebního zákona, - znaleckého posouzení nemovitosti z pohledu dalšího možného využití stavby a stanovení ceny obvyklé, - majetkoprávních problémů po rozvodu vlastníků stavby a při úmrtí vlastníka stavby, - správného způsobu ocenění takové stavby.

The paper deals with solving the issues related to the valuation of an object, which is in an "emergency" state caused by the lack of basic building maintenance in a specific example with a link to the procedures under Act No. 183/2006 Coll. on town and country planning and building code (Building Act) and the effects of property rights in dealing with a rectification of the building state. Problems particularly pointed out: - The possibilities of the appropriate building authorities to rectify the defective condition of the building under the Building Act. - The problems of an expert assessment of property in terms of further possible use of the building and common pricing. - The problems of property owners after the divorce and death of a building owner. - Of correct valuation of such building.
