Original Abstract

Autoři v článku reagují na nedávné znepřístupnění některých webů z důvodů šíření dezinformací v souvislosti s napadením Ukrajiny Ruskou federací a analyzují věcnou a právní podstatu existence informačních webů, resp. webů obecně a jejich znepřístupnění. V rámci toho především popisují, na jaké technické a právní bázi je postavena internetová dostupnost webů, jak je možné je znepřístupnit a v jakém právním režimu se tak děje či může dít. V této souvislosti se pak zabývají právní povahou žádosti vlády a dalších subjektů o znepřístupnění některých webů a možnými právními důsledky toho, že žádosti bylo dočasně vyhověno. Reagují na zatím jedinou známou žalobu, která byla v této souvislosti podána. Současně upozorňují na velmi nedostatečnou právní úpravu v této oblasti.

English abstract

In this article, the authors react to the recent disabling of some websites due to the spread of disinformation in connection with the invasion of Ukraine by the Russian Federation and analyze the factual and legal nature of the existence of information websites, or websites in general, and their disabling. In particular, they describe the technical and legal basis on which the Internet accessibility of websites is based, how they can be made inaccessible and under what legal regime this is or can be done. In this context, they then address the legal nature of requests from the government and other entities to make certain websites inaccessible and the possible legal consequences of temporarily granting the request. They respond to the only known lawsuit that has been filed in this context so far. At the same time, they draw attention to the very weak legal framework in this area.
