Administrative Law

Subject is aimed at problems of administrative law. Goal of the subject is to acquaint students with basic questions of state administration. Subject, as a pedagogical discipline, is divided into 3 main parts: general, procedural and special.
In term of general part students learn basic terms of state administration, organization structure, basics from the division of state administration (state administration and autonomy) and with division of competencies.
In procedural part students learn basics of administrative proceedings and general procedure according to Administrative Procedure Code.
In special part students learn basic terms and institutes in selected branches of administrative law (building law, cadastral law, protection of landmarks, law in traffic and small business, etc.).

Planned learning activities and teaching methods

Teaching is carried out through lectures that consist of interpretations of basic principles, methodology of given discipline, problems and their exemplary solutions.

Assesment methods and criteria linked to learning outcomes

Oral exam according to individual knowledge of student.

Course curriculum

1. Public administration and administrative law (general definition, state authority and autonomy, general terms of administrative law).
2. Organization of public administration (central bodies, bodies of state authority, bodies of interest and occupational autonomy).
3. Administrative acts and other forms of activity (functions, methods, activity, administrative acts - normative, individual, public service agreements, factual actions with direct legal consequences).
4. Control of public authority (forms, division).
5. Administrative proceedings (definition, basic principles).
6. Procedures according to Administrative Procedure Code (subjects, course of proceedings, decision and verification).
7. Administrative criminal law (responsibility for administrative delict etc.)
8. Public building law (basic principles and differentiation from private building law, land planning).
9. Building and area proceedings (land proceedings, types, procedure, building permission proceedings, announcement of a building, buildings without permission and announcement, building beneficial, disposal of a building).
10. Cadastre (organization and content of administration).
11. Protection of landmarks (protection procedures,declaring a historic landmark).
12. Internal administration (administration of personal status of inhabitants, security and asylum).
13. Administration at department of traffic (rail traffic, road traffic, roads, air transport, water transport).
